ARGOS Terms & Conditions

1. Operator and scope

These Terms govern access to and use of ARGOS, an AI-assisted personal chief of staff service (the Service) provided by errandom Fischer, a sole proprietorship operated by Kenneth Fischer, Hardstrasse 20, CH-8304 Wallisellen, Switzerland (we, us, or Operator).

By creating an account or affirmatively accepting these Terms, you agree to them. If you use the Service on behalf of an organisation, you confirm that you have authority to bind that organisation. Mandatory rights that apply to you as a consumer remain unaffected.

2. Eligibility and beta access

You must be at least 18 years old and legally capable of entering into a contract. ARGOS is currently an invitation-only beta. Access is personal, limited, revocable and may be subject to usage limits.

Beta features may be incomplete, change without notice, contain errors or become temporarily unavailable. We may reset or discontinue beta features when reasonably necessary for security, compliance or product development. You should keep your own copies of important information and must not use the beta as the sole system of record for critical matters.

3. What ARGOS provides

ARGOS uses software, rules and generative AI to organise information, create drafts, identify priorities, make recommendations and, where supported and authorised, interact with connected third-party services.

ARGOS is an AI system. Its output is generated probabilistically and can be incorrect, incomplete, outdated, misleading or unsuitable for your circumstances. ARGOS is not a human assistant and does not possess judgment, intent or awareness.

The Service is not designed for emergency response, medical diagnosis or treatment, legal representation, regulated financial advice, credit or insurance decisions, employment selection, safety-critical device control or any other use where an error could reasonably cause death, personal injury, serious financial loss or unlawful discrimination.

4. Accounts and security

You must provide accurate account information, keep your authentication methods secure and notify us promptly at info@errandom.com if you suspect unauthorised access. You are responsible for activity performed through your account unless it results from a security failure for which we are legally responsible.

You may not share an invitation or account, bypass access controls, probe the Service for vulnerabilities without written authorisation, or use another person's credentials.

5. Connected services and permissions

You choose which supported services to connect, such as email, calendar, files, health, travel, social-media, household or smart-home services. Connections are optional and can be disconnected.

When you connect a service:

Do not grant broader permissions than you are comfortable providing. Revoking a connection stops future access but does not automatically delete information already stored in ARGOS; use ARGOS's deletion controls for that.

6. AI providers and processing

ARGOS may send the information needed for a request, including personal data and connected-service context, to the external AI provider identified to you. The current processor list is published in the ARGOS Subprocessor and Third-Party Service List.

ARGOS must not silently route your information to a different external AI provider. Adding or changing an external AI provider requires an updated disclosure and, where consent is the legal basis, your consent before that provider is used.

You should avoid entering information that is unnecessary for the task. Do not provide highly sensitive information unless the relevant feature clearly supports it and you have decided that the benefit justifies the risk.

7. User data and third-party data

You retain ownership of content and personal data you provide, subject to the rights of others. You grant us a limited, non-exclusive right to host, copy, process, transmit, format and display that content only as needed to operate, secure and improve the Service, comply with your instructions and meet legal obligations.

You are responsible for having a lawful basis and appropriate authority to provide information about other people, including family members, colleagues, contacts, children and household members. You must not use ARGOS to covertly monitor, profile or make consequential decisions about another person.

We do not acquire ownership of your content. We will not use private user content to train a general-purpose model unless we first make a separate, clear disclosure and obtain any consent required by law.

8. Human review and approval

You must review important output and source information before relying on it. Unless a feature clearly states otherwise and you have deliberately enabled it, ARGOS should request your approval before an action sends a communication, publishes content, submits an application, changes a calendar, makes a purchase or booking, shares data, controls a physical device, or otherwise has an external effect.

Approval does not transfer responsibility for the action to ARGOS. You are responsible for checking recipients, facts, dates, prices, legal obligations, attachments, permissions and likely consequences.

9. Professional and consequential matters

ARGOS provides general information and organisational assistance, not medical, mental-health, legal, tax, accounting, investment, insurance, employment, immigration, travel-security or other professional advice. No professional-client, fiduciary or agency relationship is created.

For emergencies, contact the appropriate emergency service or qualified professional. Do not delay seeking professional help because of ARGOS output. Additional warnings in the ARGOS AI and Service Disclaimers form part of these Terms.

10. Acceptable use

You must not use the Service to:

We may investigate suspected misuse and suspend access where reasonably necessary to protect users, third parties, the Service or legal compliance. Where appropriate, we will provide notice and an opportunity to address the issue.

11. Intellectual property and feedback

The Service, software, design, branding and documentation are owned by us or our licensors. These Terms give you a limited, revocable, non-transferable right to use the Service during the term; they do not transfer our intellectual property.

Subject to applicable law and third-party rights, you may use AI-generated output created for you. Similar or identical output may be generated for others, and we do not guarantee that output is unique or eligible for intellectual-property protection.

If you voluntarily provide feedback, you allow us to use it without restriction or payment, provided we do not publicly identify you without permission.

12. Privacy

Our Privacy Notice explains how we process personal data. The Privacy Notice is not a waiver of your rights and does not replace any consent required for optional processing.

13. Availability, support and changes

We aim to operate ARGOS with reasonable care but do not guarantee uninterrupted, error-free or permanently available service. Maintenance, security incidents, internet failures and third-party outages may affect availability.

We may change the Service to improve it or address security, law, provider changes or technical constraints. If a change materially reduces a paid core feature, we will provide any notice or remedy required by applicable law.

Beta support is provided on a reasonable-efforts basis through info@errandom.com.

14. Fees

The invitation-only beta is currently free of charge. We will not charge you without showing the price and obtaining your agreement.

Before introducing paid plans, these Terms must be updated with prices, taxes, billing frequency, renewal, cancellation, refunds, trial conversion and consumer withdrawal rights. Paid access must not begin until those terms and the required consumer information are in place.

15. Suspension and termination

You may stop using ARGOS at any time, disconnect services and use the in-product export and deletion controls.

We may suspend or terminate access for material breach, security risk, unlawful use, non-payment under a future paid plan, or discontinuation of the Service. We will act proportionately and provide reasonable notice when circumstances permit.

Termination ends your right to use the Service. Provisions that by their nature should survive remain effective, including ownership, accrued payment obligations, liability limits and dispute provisions.

16. Data export and deletion

ARGOS provides a downloadable export of durable account data. Authentication secrets, including OAuth access and refresh tokens, are excluded from the export.

The in-product delete function irreversibly removes the user's ARGOS durable data and stored connection credentials within the active account namespace, subject to technical completion, legally required retention and limited backup lifecycle. You should export anything you need before deletion. Deleting ARGOS data does not delete information held independently by a connected third party.

17. Warranties

We will provide the Service with the level of care required by applicable law. Except for rights and warranties that cannot lawfully be excluded, the beta Service is provided on an "as available" basis. We do not warrant that AI output is accurate, complete, fit for a particular purpose or free of third-party rights.

18. Liability

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited, including liability for intentional misconduct or gross negligence, death or personal injury where applicable, or mandatory consumer rights.

To the extent permitted by law, neither party is liable for indirect or consequential loss that was not reasonably foreseeable when the contract was formed. For a free beta, our aggregate liability arising from ordinary negligence is limited to CHF 100, to the extent such a cap is lawful. For a paid Service, any cap must be stated in the applicable plan or order.

These limitations do not reduce your obligation to review consequential output and approve external actions.

19. Changes to these Terms

We may update these Terms. We will identify the new version and effective date. For material changes, we will provide reasonable advance notice and request renewed acceptance where required. Changes do not apply retroactively unless the law requires it or you expressly agree.

20. Governing law and disputes

These Terms are governed by Swiss law, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.

Subject to mandatory consumer venue rules, the courts at the Operator's seat in Wallisellen have jurisdiction. The competent district court is Bezirksgericht Bülach. Consumers retain any right to bring proceedings in another competent court under mandatory law.

Before filing a claim, please contact info@errandom.com so the parties can try to resolve the issue informally.

21. General

If a provision is unenforceable, the remaining provisions remain effective and the invalid provision will be replaced only to the extent legally permissible. Our failure to enforce a provision is not a waiver. You may not assign your account or these Terms without our consent; we may transfer the agreement as part of a reorganisation or transfer of the Service, subject to applicable notice and consumer rights.
